Terms & Conditions
1. Acceptance and scope
These Terms & Conditions govern use of towardriveragency.com and any enquiry or informational functionality provided through it. By accessing or using the website, you agree to these terms. If you do not agree, you must stop using the website. Separate booking terms, venue rules, promotional conditions, responsible gaming requirements or supplier terms may apply to particular services and will prevail to the extent of a direct inconsistency.
The website presents information about Towardriveragency, an Australian casino hotel concept and venue-related services. The website itself does not provide remote gambling, accept online wagers, hold customer gambling funds or guarantee access to any gaming activity.
2. Operator and contact
The website is operated by Towardriveragency Pty Ltd, located at 88 Southbank Boulevard, Southbank VIC 3006, Australia. General and legal enquiries may be sent to info@towardriveragency.com.
References to we, us and our mean Towardriveragency Pty Ltd. References to you and your mean the website visitor or person making an enquiry.
3. Eligibility and age
You may use general website information only if you can lawfully do so. Gambling areas and gambling activities are strictly limited to persons aged 18 years or older. Proof of age and identity may be required at a venue. A person who is under 18 must not attempt to access gambling areas, participate in gambling, submit false age information or use another person’s identification.
Accommodation, dining, events and other non-gambling services may have separate age, supervision, identification or booking conditions. A parent, guardian or authorised adult is responsible for any lawful request involving a minor.
4. Lawful use
You must use the website only for lawful purposes. You must not interfere with its operation, attempt unauthorised access, introduce malicious code, scrape content in a manner that burdens the service, impersonate another person, submit false or misleading information, infringe intellectual-property rights, harass staff or users, or use the website to facilitate unlawful gambling, fraud, money laundering or other prohibited conduct.
We may restrict or block access where reasonably necessary to protect the website, users, staff, systems, legal rights or compliance obligations.
5. Information only; no guarantee of availability
Website content is general information and may change without notice. Images may be illustrative. Facilities, opening hours, games, room types, events, packages, prices, inclusions and availability may differ from descriptions or may be suspended, limited or withdrawn.
Nothing on the website constitutes a binding offer unless expressly stated. A contract for a service arises only when the relevant request is accepted through an authorised process and any required confirmation, payment or identification step has been completed.
6. Casino and gaming conditions
All gambling is subject to applicable Australian and Victorian law, licence conditions, regulatory directions, venue rules, game rules, identification requirements, responsible gaming controls and decisions of authorised personnel. Entry may be refused or withdrawn where legally permitted, including for age, identification, safety, intoxication, disruptive conduct, exclusion, self-exclusion or compliance reasons.
Games involve risk. Outcomes are uncertain, losses are possible and past results do not predict future outcomes. We do not promise winnings, profit, uninterrupted access to a game or any particular return. You are responsible for deciding whether to participate and for gambling within personal limits.
7. Responsible gaming
You must not use the website or any service to evade responsible gaming controls, exclusion arrangements, spending limits, identity checks or venue directions. If gambling is causing concern, stop and seek support. Venue personnel may provide information about available responsible gaming services and may take steps required by law or policy.
Promotional language on the website must not be interpreted as financial advice, a statement that gambling is a way to earn income, or a guarantee of success.
8. Enquiries and contact form
When submitting an enquiry, you must provide accurate information and a valid contact method. Do not include payment-card data, passwords, government identifiers, health records or copies of identity documents in the general form. Submission does not guarantee a response, reservation, entry, service or contractual acceptance.
The current static website form performs browser-side validation and confirmation. Delivery of an enquiry to a business mailbox requires a compatible server-side form handler configured by the website host. You should use the published email or telephone contact if the form handler has not been enabled.
9. Bookings, accommodation and events
Accommodation, event and package requests may be subject to availability, confirmation, deposit, cancellation, check-in, identification, security, occupancy and conduct conditions communicated through the applicable booking channel. Prices may include or exclude taxes, fees and optional services as stated at the time of confirmation.
Guests are responsible for reviewing confirmations and notifying us promptly of errors. Special requests are not guaranteed unless expressly accepted in writing. Accessibility requests should be made as early as possible so that available arrangements can be assessed.
10. Payments and refunds
The public website does not currently process online payments. If payment functionality is introduced or a separate authorised payment channel is used, the amount, currency, merchant, fees, security process, cancellation rights and refund conditions will be disclosed before payment.
Chargebacks or payment disputes must not be used dishonestly. Refund eligibility depends on the applicable service terms, consumer law and the circumstances of the transaction.
11. Promotions and offers
Promotions, packages, competitions and offers may have separate terms including eligibility, dates, capacity, redemption, exclusions, identity checks and cancellation conditions. Promotional materials are subject to those specific terms. Unless expressly stated, offers cannot be combined, transferred, exchanged for cash or used after expiry.
We may correct an obvious error, suspend a promotion affected by technical or legal problems, or disqualify participation involving fraud, manipulation, ineligibility or breach of the relevant rules, subject to applicable law.
12. Intellectual property
The website and its text, layout, graphics, logos, photographs, code and other material are owned by us or used under licence and are protected by intellectual-property laws. You may view the website and make a temporary copy for personal, non-commercial use.
You must not reproduce, republish, sell, distribute, modify, frame, reverse engineer or exploit protected material without prior written permission, except where a mandatory legal exception applies. Third-party marks remain the property of their respective owners.
13. User submissions
You retain ownership of content you submit, but grant us a non-exclusive licence to use, store, reproduce and communicate it as reasonably necessary to respond to the submission, provide a requested service, maintain records, protect rights and comply with law.
You must not submit content that is unlawful, defamatory, threatening, discriminatory, infringing, deceptive, confidential without authority, malicious or technically harmful.
14. Privacy
Personal information is handled as described in our Privacy Policy. By submitting information, you acknowledge that it will be processed for the purposes stated at collection and in that policy. You remain responsible for the accuracy and lawfulness of information you provide about yourself or another person.
15. Third-party links and services
Third-party websites, maps, booking channels, payment providers, social platforms and other services are controlled by their respective operators. A link does not imply endorsement or responsibility. Their terms, privacy practices, availability and security apply independently.
You use third-party services at your own discretion and should verify the operator, price, cancellation conditions and security before proceeding.
16. Website availability and security
We aim to maintain the website but do not guarantee continuous, error-free or secure access. Access may be interrupted for maintenance, hosting incidents, cyber-security response, network failure, legal compliance or events beyond reasonable control.
You are responsible for using current software, maintaining device security and backing up information. We may change, suspend or discontinue website functionality without notice where reasonably necessary.
17. Disclaimers
To the maximum extent permitted by law, website content is provided on an as-is and as-available basis. We do not warrant that all information is complete, current, accurate for every purpose or free from technical errors. Nothing excludes a guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law where applicable.
General descriptions of gaming, entertainment, accommodation or guest experiences are not professional, financial, medical or legal advice.
18. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, the website, reliance on general content, third-party services, unauthorised access or events beyond reasonable control.
Where liability cannot be excluded but may be limited, it is limited to the extent permitted by law. Nothing in these terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where exclusion is prohibited, or any other non-excludable liability.
19. Indemnity
To the extent permitted by law, you agree to indemnify us against loss, damage, liability and reasonable costs arising from your unlawful use of the website, material breach of these terms, infringement of another person’s rights or unauthorised submission of another person’s information. This obligation does not apply to the extent the loss was caused by our own negligence or unlawful conduct.
20. Suspension and termination
We may suspend or terminate website access where reasonably necessary because of a breach, security risk, fraud concern, legal requirement or operational decision. Provisions intended to survive termination, including intellectual property, disclaimers, liability, indemnity and dispute provisions, continue to apply.
21. Governing law and disputes
These terms are governed by the laws of Victoria, Australia, and applicable Commonwealth law. Courts with jurisdiction in Victoria may hear disputes, subject to any mandatory consumer forum or law that applies to you.
Before starting formal proceedings, the parties should attempt in good faith to resolve the dispute through written notice and reasonable discussion, except where urgent relief is required.
22. Changes to these terms
We may update these terms when services, law, technology or business practices change. The revised version applies from the effective date shown on this page. Continued use after that date constitutes acceptance, subject to mandatory law.
23. Severability and entire agreement
If a provision is invalid or unenforceable, it will be read down or severed to the minimum extent necessary and the remaining provisions will continue. These terms, together with documents expressly incorporated by reference and any service-specific terms, form the agreement concerning website use. A failure to enforce a provision is not a waiver.
